1. Acceptance of Terms

By accessing and using Kispo AI ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Kispo AI is a comprehensive AI-powered design platform for architects and interior designers, offering 40+ applications including:

• 28 Photo Apps: 2D to 3D rendering, interior/exterior visualization, material transformation, lighting effects
• 12 Video Apps: Cinematic walkthroughs, fly-arounds, animated material changes, interior/exterior tours
• AI Image Editor: 8 AI models for creative editing, retouching with mask painting, upscaling (2x, 4x, 6x)
• Project Management: Organization, filtering, and storage of generated content
• Credit-based system: 1 credit = $0.0875 for users

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up-to-date

4. Usage Rights and Restrictions

Permitted Uses

You may use the Service for:

• Professional architectural and interior design work
• Personal creative projects
• Educational purposes
• Commercial projects in accordance with your subscription plan

Prohibited Uses

You may not:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer or replicate the AI models
• Upload content that infringes on intellectual property rights
• Share your account credentials with others
• Use automated systems to access the Service beyond rate limits
• Generate content that is harmful, offensive, or violates community standards

5. Intellectual Property

Your Content

You retain all rights to the images and content you upload to the Service. By uploading content, you grant us a license to process, display, and store your content solely for the purpose of providing the Service.

Generated Content

You own the output generated by the Service using your input. However, similar outputs may be generated for other users with similar inputs. We reserve the right to use anonymized, aggregated data to improve our services.

Our Platform

All rights, title, and interest in the Service, including all software, algorithms, and AI models, remain the exclusive property of Kispo AI.

6. Payment and Subscriptions

• Subscription Plans: Starter ($9/month - 50 credits), Pro ($29/month - 200 credits), Max ($49/month - 500 credits)
• Subscription fees are charged monthly in advance via Stripe
• Credits reset on the date of each monthly billing cycle
• Unused credits do not roll over to the next billing period
• Users receive 10 free credits upon signup
• One-time credit packs available for purchase outside of subscriptions
• Refunds may be requested and are subject to admin approval based on platform usage
• We reserve the right to modify pricing with 30 days notice

7. Data Retention and Storage

• Generated files and user content are stored for 90 days from creation date
• Files are automatically deleted after the 90-day retention period
• Users can manually delete files and projects at any time
• Upon account deletion, all associated data is permanently removed

8. Limitation of Liability

To the fullest extent permitted by law, Kispo AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service.
